CNJ creates working group to improve judicial reorganizations and bankruptcies.
The National Council of Justice (CNJ) has formed a working group whose mission is to improve judicial reorganization and bankruptcy processes, while simultaneously promoting the stability of the business environment with a view to national development.
CNJ Ordinance 199/2020 established the working group for one year, assigning it the task of conducting studies and diagnoses on the institutional framework, training and capacity building for magistrates, and formulating regulations. The aim is also to expedite the processing of cases and ensure greater legal certainty.
This measure aligns with one of the key objectives of the administration of Minister Luiz Fux, president of the body. "We want to continue the action initiated in 2018 to modernize, increase the effectiveness, and reduce bureaucracy in the Judiciary's actions in these processes," explains Councilor Henrique Ávila. He is part of the working group along with 18 other legal experts, including lawyers, judges, appellate judges, and ministers.
This is not the first time the CNJ (National Council of Justice) has encouraged work on judicial reorganizations and bankruptcies this year. Recommendations 71/2020 and 72/2020 already sought to improve performance on the subject, and Recommendation 63/2020, issued at the beginning of the Covid-19 crisis, indicated ways to maintain the continuity of such processes in line with measures to prevent the disease.
